Booking and stay conditions

These conditions govern the booking and use of the holiday accommodation VV_CMBAJAMAR, located at 107 Carretera General de Bajamar, 38250 Bajamar, San Cristóbal de La Laguna, Santa Cruz de Tenerife, registered in the General Tourism Registry of the Canary Islands under number VV-38-4-0093899 / T1546.
By confirming a booking through this website, the user fully accepts these conditions. We recommend reading them carefully before making your booking.

2. Purpose of the contract
The purpose of the contract is the temporary assignment of use of the holiday accommodation VV_CMBAJAMAR for tourism, leisure or rest purposes, for the period of time and under the conditions indicated at the time of booking. This contract is excluded from Law 29/1994, of 24 November, on Urban Leases (LAU), pursuant to Article 5.e).
3. Booking process
The booking process through this website follows these steps:
- Date and rate selection: the user selects check-in and check-out dates, number of guests and rate type from the availability calendar.
- Personal details: the user provides their identification and contact details required to formalise the booking.
- Secure payment: the user is redirected to the Stripe payment gateway to complete the payment. The transaction is processed in a secure, encrypted environment certified PCI-DSS Level 1. Card details are not stored on our servers.
- Confirmation: once payment is completed, the user receives an email with the booking confirmation, booking reference, and a link to complete the online check-in.
The booking is only formalised upon receipt of payment. Until that point, availability of the selected dates is not guaranteed.
4. Prices and taxes
Prices shown on the website are final prices per night and include the applicable Canary Islands General Indirect Tax (IGIC). The Canary Islands has its own tax regime, so mainland Spanish VAT does not apply.
The total price of the stay is calculated based on the selected dates, number of guests and chosen rate, and is shown clearly and itemised before proceeding to payment.
Prices may vary according to season, booking lead time or length of stay. The applicable price is the one in effect at the time of booking.
5. Payment methods
Payment is processed through the secure Stripe gateway, which accepts major credit and debit cards (Visa, Mastercard, American Express). The transaction may require strong authentication (3D Secure / SCA) in accordance with the European Payment Services Directive (PSD2).
The full amount of the stay is charged at the time of booking.
6. Confirmation and documentation
After completing payment, the user receives by email:
- Booking confirmation with the unique reference number.
- Summary of dates, guests and total price.
- Link to manage the booking (view, modify or cancel).
- Link to complete the online check-in before arrival.
This email constitutes the contractual confirmation on a durable medium, pursuant to Article 98 of Royal Legislative Decree 1/2007.
7. Right of withdrawal
As this is an accommodation service with specific dates, the 14-day right of withdrawal generally provided for distance contracts cannot be exercised. However, the user has the cancellation conditions described below.
8. Cancellation policy
Flexible rate (standard)
- Free cancellation up to 7 days before the check-in date. 100% of the amount is refunded.
- Cancellation between 7 and 2 days before: 50% of the total amount is refunded.
- Cancellation less than 48 hours before or no-show: no refund is given.
Non-refundable rate
- No cancellation is accepted and no refund is given.
- In cases of duly proven force majeure, the owners will assess each situation individually.
Cancellations are managed through the booking management page or by email. The refund will be made using the same payment method used for the booking, within a maximum of 14 days from confirmation of the cancellation.
9. Check-in and check-out
- Check-in time: from 15:00 to 20:00.
- Check-out time: by 12:00.
It is mandatory to communicate your approximate arrival time in advance. You can do this during the booking process or by email to info@apartamentobajamar.com.
Arrivals outside the established hours must be agreed in advance and may be subject to availability. Late departures may incur an additional charge.
Guests must present a valid photo identification document (national ID, residence permit or passport) upon check-in.
10. Traveller registration
In accordance with Royal Decree 933/2021, of 26 October, establishing the documentary registration and information obligations of natural or legal persons engaged in accommodation and motor vehicle rental activities, it is mandatory to collect and report to the Ministry of the Interior the identification data of all guests.
Before your arrival, you will receive an email link to complete the online check-in, where you must provide the data required by regulations: full name, identity document, date of birth, nationality, usual address and contact details.
This data will be transmitted through the SES.Hospedajes platform of the Ministry of the Interior and kept for a period of 3 years from the end of the stay, pursuant to Article 27 of RD 933/2021.
11. House rules
Adults only
VV_CMBAJAMAR is accommodation exclusively for adults (over 18 years of age). The minimum age for check-in is 18 years. Children are not admitted. No cots or extra beds are provided.
Maximum capacity
The maximum capacity of the apartment is 2 people. Additional guests not listed on the booking are not permitted.
Pets
No pets of any kind are allowed.
No smoking
VV_CMBAJAMAR is a smoke-free accommodation. Smoking is strictly prohibited inside the apartment, including e-cigarettes. Failure to comply with this rule may result in an additional cleaning charge.
Parties and noise
- Parties, events, stag/hen dos or similar gatherings are not permitted.
- Guests must respect the neighbourhood's rest at all times.
- Mandatory quiet hours: from 23:00 to 08:00.
Care of the accommodation
The guest agrees to maintain the apartment in good condition during the stay and to return it in a reasonable state of cleanliness and order upon departure.
12. Guest liability and damages
The guest is liable for any damage caused to the accommodation, furniture, appliances or facilities during their stay, as well as for any damage caused to third parties (neighbours, community) as a result of their conduct.
The owners reserve the right to claim from the guest the cost of repair or replacement of any damaged item. In cases of serious damage or repeated breach of the rules, the owners may terminate the stay immediately without right to a refund.
13. Special requests
VV_CMBAJAMAR accepts special requests which you can indicate when making your booking or by email. All requests are subject to availability and may involve an additional supplement.
14. Complaint forms
In compliance with the tourism regulations of the Autonomous Community of the Canary Islands (Decree 113/2015 and Law 6/2025), the accommodation has official complaint forms available to guests.
You may request a complaint form in person during your stay or contact:
- Directorate General for Tourism Planning and Promotion of the Government of the Canary Islands.
- Municipal Consumer Information Office (OMIC) of the Municipality of San Cristóbal de La Laguna.
15. Personal data protection
Personal data provided during the booking, check-in and stay process will be handled in accordance with the Privacy Policy. When completing the booking form, the user must expressly accept the data processing conditions.
16. Dispute resolution
For any complaint related to the booking or stay, the user may first contact info@apartamentobajamar.com, where we will endeavour to resolve the matter amicably.
Furthermore, in accordance with Regulation (EU) 524/2013, we inform you of the existence of the Online Dispute Resolution Platform of the European Commission, accessible at: https://ec.europa.eu/consumers/odr.
17. Applicable legislation
These conditions are governed by current Spanish legislation, with particular attention to:
- Royal Legislative Decree 1/2007 — General Law for the Defence of Consumers and Users.
- Law 34/2002 — Information Society Services and Electronic Commerce (LSSI-CE).
- Decree 113/2015 — Holiday accommodation regulations of the Canary Islands.
- Law 6/2025 — Sustainable Regulation of Tourist Use of Housing (Canary Islands).
- Royal Decree 933/2021 — Documentary registration obligations for accommodation.
- Regulation (EU) 2016/679 — General Data Protection Regulation (GDPR).
For any dispute, both parties submit to the courts and tribunals of Santa Cruz de Tenerife, without prejudice to the consumer's mandatory jurisdiction.
